Terms of service

1. The agreement
These terms are a contract between you (or the organisation you represent) and [Company legal name], [address], Netherlands, KvK [number] ("cmdk", "we"). By creating an account or using cmdk you accept them. If you use cmdk for an organisation, you confirm you may bind that organisation.
2. The service
cmdk is an AI workspace: chat with AI models, automations across connected apps, and meeting recording with transcripts and summaries. Features evolve; we may improve or change them as long as the service keeps materially delivering what you pay for.
3. Accounts and workspaces
- Keep your sign-in credentials confidential; you are responsible for activity on your account.
- Workspace admins control membership, roles and workspace data, including deletion.
- You must be at least 16 to use cmdk.
4. Plans, credits and billing
- Paid plans are billed per user, monthly or yearly, in advance.
- Every plan includes the full product; plans differ in the monthly credit allowance that powers chats, automation runs and meeting intelligence.
- Unused credits expire at the end of each billing month and do not roll over.
- You can upgrade, downgrade or cancel at any time; changes are prorated and cancellation takes effect at the end of the paid period.
- Prices exclude VAT where applicable. We announce price changes at least 30 days before they apply to you.
5. Acceptable use
You agree not to:
- break the law, infringe others' rights, or process data you have no right to process;
- probe, overload or disrupt the service, or bypass usage limits;
- resell the service or use it to build a competing product;
- use AI output to mislead people about its origin where disclosure is required.
We may suspend accounts that put the service or others at risk.
6. Your content
You own the content you bring to and create in cmdk. You give us the limited licence needed to operate the service: storing your content, sending your prompts and relevant context to the AI model providers you invoke, and running the automations you configure. We do not train models on your content and we do not sell it.
You are responsible for having the necessary rights and consents for content you upload and meetings you record, including telling participants a meeting is being recorded where the law requires it.
7. AI output
AI-generated output can be wrong, incomplete or biased. Review it before relying on it, especially for legal, financial, medical or other consequential decisions. Output may be similar to output generated for others; to the extent we hold any rights in it, we assign them to you.
8. Third-party services
Integrations connect cmdk to third-party apps under those apps' own terms. AI models are provided by third parties under their terms. We are not responsible for third-party services, but we choose and contract our subprocessors with care (see the privacy policy).
9. Availability, warranty and liability
- We aim for high availability but the service is provided 'as is'; Enterprise plans can include an SLA.
- To the extent the law allows, our total liability in any 12-month period is limited to the amounts you paid us in that period.
- We are not liable for indirect damages such as lost profits or lost data beyond our control. Nothing limits liability for intent or gross negligence.
10. Termination
You can stop using cmdk and delete your workspace at any time. We may terminate with 30 days' notice, or immediately for material breach. After deletion, workspace content is removed within 30 days, except what we must keep by law.
11. Changes and governing law
We may update these terms; material changes are announced at least 30 days in advance and continued use counts as acceptance. Dutch law governs this agreement and disputes go to the competent court in [city], the Netherlands, unless mandatory consumer law says otherwise.
